Terminology used

“Personal data” means any information relating to an identified or identifiable natural person (hereinafter “data subject”); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier (e.g. a cookie) or to one or more specific factors that are an expression of the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

“Processing” means any operation or set of operations performed on personal data, whether or not by automated means. The term is broad and covers practically any handling of data.

“Pseudonymisation” means the processing of personal data in such a manner that the personal data can no longer be attributed to a specific data subject without the use of additional information, provided that such additional information is kept separately and is subject to technical and organisational measures to ensure that the personal data are not attributed to an identified or identifiable natural person.

“Profiling” means any form of automated processing of personal data consisting of the use of such personal data to evaluate certain personal aspects relating to a natural person, in particular to analyse or predict aspects concerning that natural person’s performance at work, economic situation, health, personal preferences, interests, reliability, behaviour, location or movements.

“Controller” means the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data.

“Processor” means a natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller.

Relevant legal bases

In accordance with Art. 13 GDPR, we inform you of the legal bases of our data processing. Unless the legal basis is stated in the privacy policy, the following applies: the legal basis for obtaining consent is Art. 6 (1) (a) and Art. 7 GDPR; the legal basis for processing for the performance of our services and the implementation of contractual measures as well as for responding to enquiries is Art. 6 (1) (b) GDPR; the legal basis for processing to comply with our legal obligations is Art. 6 (1) (c) GDPR; and the legal basis for processing to safeguard our legitimate interests is Art. 6 (1) (f) GDPR. In the event that vital interests of the data subject or another natural person require the processing of personal data, Art. 6 (1) (d) GDPR serves as the legal basis.

Security measures

In accordance with Art. 32 GDPR, taking into account the state of the art, the costs of implementation and the nature, scope, context and purposes of processing as well as the risk of varying likelihood and severity for the rights and freedoms of natural persons, we implement appropriate technical and organisational measures to ensure a level of protection appropriate to the risk.

These measures include, in particular, safeguarding the confidentiality, integrity and availability of data by controlling physical access to the data, as well as access to, input, transfer, securing the availability and separation of the data. Furthermore, we have established procedures that ensure the exercise of data subject rights, the deletion of data and the response to threats to the data. In addition, we take the protection of personal data into account as early as the development or selection of hardware, software and procedures, in accordance with the principle of data protection by design and by default (Art. 25 GDPR).

Cooperation with processors and third parties

If, in the course of our processing, we disclose data to other persons and companies (processors or third parties), transmit it to them or otherwise grant them access to the data, this is done only on the basis of a legal permission (e.g. if a transfer of data to third parties, such as payment service providers, is necessary for the performance of a contract pursuant to Art. 6 (1) (b) GDPR), if you have consented, if a legal obligation provides for this or on the basis of our legitimate interests (e.g. when using agents, web hosts, etc.).

If we commission third parties to process data on the basis of a so-called “data processing agreement”, this is done on the basis of Art. 28 GDPR.

Transfers to third countries

If we process data in a third country (i.e. outside the European Union (EU) or the European Economic Area (EEA)) or if this occurs in the context of using third-party services or disclosing or transferring data to third parties, this is only done if it is necessary to fulfil our (pre-)contractual obligations, on the basis of your consent, due to a legal obligation or on the basis of our legitimate interests. Subject to legal or contractual permissions, we process or have data processed in a third country only if the special requirements of Art. 44 et seq. GDPR are met. This means that processing takes place, for example, on the basis of special guarantees, such as the officially recognised determination of a level of data protection corresponding to that of the EU (e.g. for the USA through the “EU-U.S. Data Privacy Framework” on the basis of the European Commission’s adequacy decision of 10 July 2023, provided that the recipient is certified under it) or compliance with officially recognised special contractual obligations (so-called “standard contractual clauses”).

Rights of data subjects

You have the right to request confirmation as to whether data concerning you is being processed and to obtain access to this data as well as further information and a copy of the data in accordance with Art. 15 GDPR.

In accordance with Art. 16 GDPR, you have the right to request the completion of data concerning you or the rectification of inaccurate data concerning you.

In accordance with Art. 17 GDPR, you have the right to request that data concerning you be erased without undue delay or, alternatively, in accordance with Art. 18 GDPR, to request a restriction of the processing of the data.

You have the right to receive the data concerning you that you have provided to us in accordance with Art. 20 GDPR and to request its transmission to other controllers.

Furthermore, pursuant to Art. 77 GDPR, you have the right to lodge a complaint with the competent supervisory authority.

Right to withdraw consent

You have the right to withdraw consent given pursuant to Art. 7 (3) GDPR with effect for the future.

Right to object

You may object to the future processing of data concerning you at any time in accordance with Art. 21 GDPR. In particular, the objection may be made against processing for the purposes of direct marketing.

Cookies and right to object to direct marketing

“Cookies” are small files that are stored on users’ computers. Various pieces of information can be stored within cookies. A cookie is primarily used to store information about a user (or the device on which the cookie is stored) during or after their visit to an online offering. Temporary cookies, or “session cookies” or “transient cookies”, are cookies that are deleted after a user leaves an online offering and closes their browser. Such a cookie may, for example, store the contents of a shopping basket in an online shop or a login status. Cookies that remain stored even after the browser has been closed are referred to as “permanent” or “persistent”. For example, the login status can be saved if users visit the site again after several days. Likewise, the interests of users that are used for reach measurement or marketing purposes can be stored in such a cookie. “Third-party cookies” are cookies that are offered by providers other than the controller operating the online offering (otherwise, if they are only the controller’s cookies, they are referred to as “first-party cookies”).

We may use temporary and permanent cookies and explain this within the scope of our privacy policy.

If users do not want cookies to be stored on their computer, they are asked to deactivate the corresponding option in their browser’s system settings. Stored cookies can be deleted in the browser’s system settings. Excluding cookies may lead to functional restrictions of this online offering.

A general objection to the use of cookies used for online marketing purposes can be declared for a large number of services, especially in the case of tracking, via the US site http://www.aboutads.info/choices/ or the EU site http://www.youronlinechoices.com/. Furthermore, the storage of cookies can be prevented by deactivating them in the browser settings. Please note that in this case not all functions of this online offering may be usable.

Deletion of data

The data processed by us will be erased or its processing restricted in accordance with Art. 17 and 18 GDPR. Unless expressly stated within this privacy policy, the data stored by us will be deleted as soon as it is no longer required for its intended purpose and there are no statutory retention obligations preventing deletion. If the data is not deleted because it is required for other legally permissible purposes, its processing will be restricted. This means that the data is blocked and not processed for other purposes. This applies, for example, to data that must be retained for commercial or tax law reasons.

According to statutory requirements in Germany, data is retained in particular for 10 years pursuant to §§ 147 (1) no. 1, (3) of the German Fiscal Code (AO), 257 (1) no. 1, (4) of the German Commercial Code (HGB) (books, records, inventories, annual financial statements, management reports, commercial books, etc.), for 8 years pursuant to §§ 147 (1) no. 4, (3) AO, 257 (1) no. 4, (4) HGB (accounting vouchers) and for 6 years pursuant to §§ 147 (1) nos. 2, 3 and 5, (3) AO, 257 (1) nos. 2 and 3, (4) HGB (commercial and business letters and other documents relevant for taxation).

Business-related processing

In addition, we process
- contract data (e.g., subject matter of the contract, term, customer category).
- payment data (e.g., bank details, payment history)
of our customers, prospective customers and business partners for the purpose of providing contractual services, service and customer care, marketing, advertising and market research.

Contacting us

When you contact us (e.g. via contact form, e-mail, telephone or social media), the user’s details are processed for the purpose of handling the contact request and its processing pursuant to Art. 6 (1) (b) GDPR. Users’ details may be stored in a customer relationship management system (“CRM system”) or comparable enquiry management system.

We delete enquiries when they are no longer required. We review the necessity every two years; statutory archiving obligations also apply.

Enquiry forms (contact, removal enquiry, volume calculator)

If you use one of our forms (contact form, removal enquiry or volume calculator), we process the details you enter – depending on the form, e.g. name, telephone number, e-mail address, preferred date, loading and unloading address, floor, removal volume and your message – in order to handle your enquiry and prepare a quotation. The legal basis is Art. 6 (1) (b) GDPR (steps taken at your request prior to entering into a contract). After submission, your details are sent to us by e-mail together with the selected language and the address of the page on which you submitted the form; they are not stored permanently on the web server. The information in the section “Contacting us” applies to their further storage and deletion.

To protect against automated spam submissions, all forms use a control field that is invisible to humans, a timestamp (forms submitted too quickly are discarded), a check as to whether the form was actually operated in the browser and a check for typical spam content; without JavaScript, a simple arithmetic question is shown instead for the removal enquiry and the volume calculator. To prevent mass submissions, we process your IP address for no more than 15 minutes in order to limit the number of submissions per form. We log rejected submissions without the IP address in plain text (only as a shortened, irreversible hash value). No third-party services are used for this; the legal basis is Art. 6 (1) (f) GDPR, our legitimate interest being the prevention of spam and abuse. To protect the forms against forged requests (so-called CSRF protection), we set a technically necessary session cookie (“PHPSESSID”), which is deleted when you close your browser. The legal basis for this is § 25 (2) no. 2 of the German Telecommunications Digital Services Data Protection Act (TDDDG) and Art. 6 (1) (f) GDPR; our legitimate interest lies in the secure operation of our forms.

Hosting and e-mail dispatch

The hosting services we use serve to provide the following services: infrastructure and platform services, computing capacity, storage space and database services, e-mail dispatch, security services and technical maintenance services, which we use for the purpose of operating this online offering.

In doing so, we or our hosting provider process inventory data, contact data, content data, contract data, usage data, meta and communication data of customers, prospective customers and visitors to this online offering on the basis of our legitimate interests in the efficient and secure provision of this online offering pursuant to Art. 6 (1) (f) GDPR in conjunction with Art. 28 GDPR (conclusion of a data processing agreement).

Collection of access data and log files

On the basis of our legitimate interests within the meaning of Art. 6 (1) (f) GDPR, we or our hosting provider collect data on every access to the server on which this service is located (so-called server log files). The access data include the name of the website accessed, file, date and time of access, amount of data transferred, notification of successful access, browser type and version, the user’s operating system, referrer URL (the previously visited page), IP address and the requesting provider.

For security reasons (e.g. to investigate misuse or fraud), log file information is stored for a maximum of 7 days and then deleted. Data whose further retention is required for evidential purposes is excluded from deletion until the respective incident has been finally clarified.

Online presences in social media

We maintain online presences within social networks and platforms in order to communicate with the customers, prospective customers and users active there and to inform them about our services there. When accessing the respective networks and platforms, the terms and conditions and data processing policies of their respective operators apply.

Unless otherwise stated in our privacy policy, we process the data of users insofar as they communicate with us within the social networks and platforms, e.g. write posts on our online presences or send us messages.

Google Ads Conversion Tracking

This website uses Google Ads conversion tracking provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. For this purpose, the Google tag (gtag.js) is loaded from Google servers when you visit our pages; in the process, your IP address is necessarily transmitted to Google. We use Google’s consent mode: as long as you have not given your consent, no Google advertising cookies are set and Google only receives cookieless signals (e.g. time of the visit, the page visited (URL), browser information, referring page and your consent status). Only after you have given your consent does Google store conversion cookies (e.g. “_gcl_aw”, “_gcl_au”) and comparable entries in your browser’s local storage (localStorage, e.g. “_gcl_ls”) on your device with a lifetime of up to 90 days. If you withdraw your consent, we delete these entries on our domain.

Using this data, we and Google compile statistics on how many users clicked on one of our ads and then accessed a conversion page. In doing so, we learn the total number of users — not who specifically clicked. Google may also transfer data to Google LLC in the USA; Google LLC is certified under the EU-U.S. Data Privacy Framework (adequacy decision of the European Commission of 10 July 2023). We store your choice in the cookie banner in the cookie “cu_analytics” (lifetime 365 days) so that the banner does not reappear on every page view; the legal basis for this is § 25 (2) no. 2 TDDDG.

Legal basis: Art. 6 (1) (a) GDPR and § 25 (1) TDDDG (consent)
Withdrawal: At any time with effect for the future via the “Cookie settings” link in the footer of every page: it reopens the cookie banner and you can select “Decline”. This does not affect the lawfulness of the processing carried out before withdrawal.
